Breach escalation procedures
Breach escalation procedures define exactly what happens from the moment a suspected data breach is detected: who is told, in what order, within what time, who decides whether it is a breach, who notifies the insurer, counsel, regulators, customers and affected individuals, and how every step is recorded. It is needed when notification deadlines under regulations such as HIPAA, GDPR or state breach laws apply, when contracts with customers specify notification windows, when an insurance policy requires prompt notice, or when an organization has discovered that nobody knew who to call. The procedures produce an escalation path with named roles and time limits, a decision framework for breach determination with counsel, notification templates and obligations mapped to each regime, and the record structure that proves the organization acted properly.

Questions
Asked before engaging.
Who decides whether it is a breach?
A defined role, with counsel, on a defined basis. The procedure removes the ambiguity that delays notification.
Do you provide legal advice?
No. Counsel does. The procedure is built with counsel so that the legal determinations have an operational path.
How does this relate to incident response planning?
Escalation procedures are the breach-specific layer of the response plan. They are often built together.
